Appealing to the Crown Court to overturn a wrongful magistrates’ court conviction

If you have been found guilty of an offense in the Magistrates' Court, you have the legal right to file an appeal to the Crown Court within 15 days from the date of your conviction. This appeal to the Crown Court involves a complete re-examination of the original case.  A Crown Court Judge, along with at least one magistrate, will preside over the appeal.

During this appeal, the court has the authority to either uphold the original conviction or replace it with a verdict of not guilty.

The sentencing procedure will be entirely re-evaluated in the presence of the Crown Court. It is important to note that the Crown Court has the discretion to either confirm the original sentence, reduce it, or increase it.

In the event that your appeal against conviction or sentence does not succeed, the court may order you to cover additional prosecution costs.
